Wenn der Präsident schweigen muss

Erik Tuchtfeld, wissenschaftlicher Mitarbeiter am Max-Planck-Institut für ausländisches öffentliches Recht und Völkerrecht, stellt anlässlich der Social-Media-Sperre des damaligen US-Präsidenten Trump am 08. Januar 2021 in der Referentenbesprechung des MPIL die rechtlichen Rahmenbedingungen vor, die Plattformen bei der Ausübung ihrer privaten Macht berücksichtigten können. Während das US-amerikanische Recht den Plattformen viele Freiheiten lässt, verpflichtet deutsches und europäisches Recht sowohl zur Löschung wie auch zur Veröffentlichung bestimmter Inhalte.
