Contemporary Sanctions as a Challenge to the Doctrine of Jurisdiction

Contemporary sanctions based on extraterritorial control of national products and infrastructure such as currencies, high-tech products, and cyberspace are stretching established doctrines of states’ jurisdiction under international law.
The presenter will highlight and discuss how these sanctions practices, in reality, create a parallel regime of jurisdiction for the exclusive benefit of states with hegemony over the global financial and supply chain. The presentation then will focus on then on the analytical relevance of existing doctrinal dichotomies between legislative and enforcement jurisdictions and between retorsion (denial of privilege) and countermeasures. Lastly, the presentation will put these regimes in question and analyzing them and their approaches.
