{"id":4136,"date":"2016-10-31T00:00:00","date_gmt":"2016-10-31T09:07:39","guid":{"rendered":"https:\/\/staging.voelkerrechtsblog.org\/articles\/grab-me-if-you-can\/"},"modified":"2020-12-09T13:28:18","modified_gmt":"2020-12-09T12:28:18","slug":"grab-me-if-you-can","status":"publish","type":"post","link":"https:\/\/voelkerrechtsblog.org\/de\/grab-me-if-you-can\/","title":{"rendered":"Grab me if you can?"},"content":{"rendered":"<p>This post opens our symposium on \u201cLand governance\u201d, which accompanies an international <a href=\"https:\/\/plone.rewi.hu-berlin.de\/de\/lf\/oe\/lsi\/termine\/fu-hu-internal-trilateral-workshop-on-comparative-perspectives-on-land-governance-in-brazil-and-india\">conference<\/a> at the <a href=\"https:\/\/plone.rewi.hu-berlin.de\/en\/lf\/oe\/lsi\/the-institute\" target=\"_blank\" rel=\"noopener noreferrer\">Law and Society Institute<\/a> of Humboldt University Berlin. Lawyers and political scientists from Germany, India and Brazil will reflect on the global scramble for land in local contexts.<\/p>\n<p>Land as such is a rather localized phenomenon, but land governance matters in much wider political, economic, social and ecological contexts: Control over land has always been linked to political and economic order \u2013 from <a href=\"http:\/\/www.sciencedirect.com\/science\/article\/pii\/S0305748816000268\" target=\"_blank\" rel=\"noopener noreferrer\">feudalism<\/a> through <a href=\"http:\/\/territorialmasquerades.net\/whigs-and-hunters\/\" target=\"_blank\" rel=\"noopener noreferrer\">capitalist industrialization<\/a> to <a href=\"http:\/\/sls.sagepub.com\/content\/14\/2\/147.refs\" target=\"_blank\" rel=\"noopener noreferrer\">(neo)liberal globalization<\/a>. Property rights in land shape relations <a href=\"http:\/\/www.cambridge.org\/de\/academic\/subjects\/politics-international-relations\/comparative-politics\/property-and-political-order-africa-land-rights-and-structure-politics?format=PB&amp;isbn=9781107649934\" target=\"_blank\" rel=\"noopener noreferrer\">between government and society<\/a>, state and markets, parliaments and courts, the national and the international. They implicate <a href=\"http:\/\/www.oapen.org\/search?identifier=595092\" target=\"_blank\" rel=\"noopener noreferrer\">all layers of law<\/a> \u2013 from local customary law through national constitutions to international human rights law and investment treaties like TTIP and CETA.<\/p>\n<p>Besides, land governance also affects the ways in which\u00a0<a href=\"http:\/\/www.cprindia.org\/research\/chapters\/tension-between-property-rights-and-social-and-economic-rights-case-study-india\" target=\"_blank\" rel=\"noopener noreferrer\">housing and food<\/a> are accessed and distributed. It is closely linked to inequality and poverty &#8211; whether we look at <a href=\"http:\/\/evictedbook.com\/books\/evicted-hc\" target=\"_blank\" rel=\"noopener noreferrer\">gentrification and evictions in urban Europe and America<\/a>, at development-induced <a href=\"http:\/\/ielrc.org\/content\/a0902.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">displacement in Asia<\/a>, or at smallholders in rural Africa who struggle against the <a href=\"http:\/\/www.fao.org\/3\/a-i3900e.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">forces of global land markets<\/a> \u2013 or \u201cland grabbing\u201d, as <a href=\"https:\/\/www.oxfamamerica.org\/take-action\/campaign\/food-farming-and-hunger\/land-grabs\/\" target=\"_blank\" rel=\"noopener noreferrer\">critics<\/a> say. As global prices for land rise, should anyone just grab it if they\u00a0can?<\/p>\n<p>More than ever, land governance also matters for the <a href=\"http:\/\/www.pnas.org\/content\/108\/9\/3465.full\" target=\"_blank\" rel=\"noopener noreferrer\">environment and biodiversity<\/a>. Land governance is natural resource governance. Ownership of forests is becoming a regulatory tool to save the global climate. And as climate policy seeks to save the forest, <a href=\"https:\/\/www.researchgate.net\/publication\/298813404_South_of_south_Examining_the_international_climate_regime_from_an_indigenous_perspective\" target=\"_blank\" rel=\"noopener noreferrer\">indigenous peoples<\/a> in many places face their third dispossession \u2013 after colonialism and industrialization this time in the name of green economy.<\/p>\n<p>In this symposium, we hope to capture some of these multi-disciplinary and multi-level aspects of land governance \u2013 and to discuss them with our readers and commentators.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/dann.rewi.hu-berlin.de\/staff\/mr?lang=en\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Michael Riegner <\/em><\/a><\/p>\n<p>&nbsp;<\/p>\n<blockquote><p>Cite as: Michael Riegner, \u201cGrab me if you can?
