{"id":24507,"date":"2025-03-14T14:00:39","date_gmt":"2025-03-14T13:00:39","guid":{"rendered":"https:\/\/voelkerrechtsblog.org\/?p=24507"},"modified":"2025-03-19T18:39:45","modified_gmt":"2025-03-19T17:39:45","slug":"call-for-contributions-symposium-on-knowledge-under-occupation","status":"publish","type":"post","link":"https:\/\/voelkerrechtsblog.org\/de\/call-for-contributions-symposium-on-knowledge-under-occupation\/","title":{"rendered":"Call for Contributions: Symposium on Knowledge under Occupation"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">We hereby announce our forthcoming online blogpost symposium, <strong>\u2018<\/strong><\/span><strong>Knowledge Under Occupation: Academic Freedom and Palestine on the Global Stage<\/strong><span style=\"font-weight: 400;\">\u2019, which will be held in collaboration with <\/span><a href=\"https:\/\/opiniojuris.org\/\"><span style=\"font-weight: 400;\">Opinio Juris<\/span><\/a><span style=\"font-weight: 400;\"> and will purport to provide a forum for critical and reflective discourse on the current state of academic freedom. A forum about its erosion amidst the heightened climate of restrictions and constraints imposed upon Palestinian advocacy, a situation that has become increasingly evident in the wake of developments having occurred across the globe since 7 October 2023. A forum also about the role and potentials of critique in a situation of epistemic inequality and injustice.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this context, one may observe with grave concern the <\/span><a href=\"https:\/\/www.cbc.ca\/radio\/asithappens\/mahmoud-khalil-columbia-chill-1.7481915\"><span style=\"font-weight: 400;\">detention<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/theintercept.com\/2024\/10\/22\/swarthmore-protest-palestine-expulsion-bullhorn\/\"><span style=\"font-weight: 400;\">suspension, and expulsion of students<\/span><\/a><span style=\"font-weight: 400;\">, the <\/span><a href=\"https:\/\/theintercept.com\/2024\/05\/16\/university-college-professors-israel-palestine-firing\/\"><span style=\"font-weight: 400;\">dismissal of academics<\/span><\/a><span style=\"font-weight: 400;\">, threats to <\/span><a href=\"https:\/\/www.marxist.ca\/article\/york-threatens-to-dissolve-all-student-unions-for-supporting-palestine-students-must-unite-against-this-administration\"><span style=\"font-weight: 400;\">dissolve student unions<\/span><\/a><span style=\"font-weight: 400;\">, and the imposition of <\/span><a href=\"https:\/\/www.nytimes.com\/2024\/11\/25\/us\/university-crackdowns-protests-israel-hamas-war.html\"><span style=\"font-weight: 400;\">restrictions on campus events<\/span><\/a><span style=\"font-weight: 400;\"> in support of Gaza civilians and in criticism of Israel\u2019s military actions, the latter of which remain subject to current <\/span><a href=\"https:\/\/www.icj-cij.org\/case\/192\"><span style=\"font-weight: 400;\">proceedings<\/span><\/a><span style=\"font-weight: 400;\"> at the International Court of Justice (ICJ) on the grounds that they may constitute actions amounting to a genocidal campaign. And most recently,\u00a0the\u00a0<\/span><span style=\"font-weight: 400;\">silencing<\/span><span style=\"font-weight: 400;\">\u00a0of important critical voices such as Francesca Albanese and Eyal Weizmann\u00a0at German Universities\u00a0<\/span><span style=\"font-weight: 400;\">sacrificing<\/span><span style=\"font-weight: 400;\">\u00a0fundamental rights and freedoms for ideological conformity.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the United Kingdom, approximately <\/span><a href=\"https:\/\/www.ohchr.org\/en\/documents\/thematic-reports\/ahrc5658-right-academic-freedom-report-special-rapporteur-right\"><span style=\"font-weight: 400;\">120 universities<\/span><\/a><span style=\"font-weight: 400;\"> have adopted the International Holocaust Remembrance Alliance (IHRA) <\/span><a href=\"https:\/\/holocaustremembrance.com\/resources\/working-definition-antisemitism\"><span style=\"font-weight: 400;\">working definition of antisemitism<\/span><\/a><span style=\"font-weight: 400;\">, which conflates criticism of Israel with antisemitism, effectively silencing lawful speech in support of Palestinian human rights and the right to self-determination. This redefinition has resulted in <\/span><a href=\"https:\/\/www.theguardian.com\/education\/2023\/sep\/13\/antisemitism-definition-used-by-uk-universities-leading-to-unreasonable-accusations\"><span style=\"font-weight: 400;\">unreasonable investigations<\/span><\/a><span style=\"font-weight: 400;\">, disciplinary actions, and <\/span><a href=\"https:\/\/www.middleeastmonitor.com\/20241016-palestinian-academic-wins-significant-victory-against-uk-university-over-leaked-confidential-details\/\"><span style=\"font-weight: 400;\">false allegations<\/span><\/a><span style=\"font-weight: 400;\"> of antisemitism against academic staff and students.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In November 2024 the German parliament adopted a <\/span><a href=\"https:\/\/dserver.bundestag.de\/btd\/20\/136\/2013627.pdf\"><span style=\"font-weight: 400;\">resolution<\/span><\/a><span style=\"font-weight: 400;\"> relying on the same working definition despite <\/span><a href=\"https:\/\/www.youtube.com\/watch?v=TkM4-g5bKr8\"><span style=\"font-weight: 400;\">massive criticism<\/span><\/a><span style=\"font-weight: 400;\"> highlighting the potential for abuse. It is noteworthy that this follows a series of repressive measures enacted by the German government against individuals or institutions engaged in advocacy for Palestinian rights in a McCarthyist manner, such as the <\/span><a href=\"https:\/\/www.euronews.com\/culture\/2024\/01\/24\/art-world-accusing-german-government-of-choking-pro-palestinian-speech\"><span style=\"font-weight: 400;\">withdrawal<\/span><\/a><span style=\"font-weight: 400;\"> of public funding from numerous arts and cultural institutions, the <\/span><a href=\"https:\/\/mondediplo.com\/outside-in\/german-police-palestine-congress\"><span style=\"font-weight: 400;\">dissolution<\/span><\/a><span style=\"font-weight: 400;\"> of events, the <\/span><a href=\"https:\/\/portal.uni-koeln.de\/en\/universitaet\/aktuell\/press-releases\/single-news\/withdrawal-of-the-albertus-magnus-professorship-2024\"><span style=\"font-weight: 400;\">withdrawal of a professorship<\/span><\/a><span style=\"font-weight: 400;\"> over a letter expressing solidarity with Palestinians and calling for a boycott of Israeli institutions, the <\/span><a href=\"https:\/\/jacobin.com\/2024\/04\/yanis-varoufakis-germany-banned-palestine-gaza\"><span style=\"font-weight: 400;\">prohibition<\/span><\/a><span style=\"font-weight: 400;\"> of politicians\u2019 entry into the country, and the <\/span><a href=\"https:\/\/www.middleeastmonitor.com\/20240820-amnesty-calls-for-probe-into-german-police-violence-against-pro-palestine-supporters\/\"><span style=\"font-weight: 400;\">heavy-handed<\/span><\/a><span style=\"font-weight: 400;\"> policing of demonstrations, to name but a few.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Comparable instances of repression and the circumscribing of academic freedom and the freedom of expression have been observed in the <\/span><a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/oct\/24\/university-professors-discipline-palestine-support\"><span style=\"font-weight: 400;\">United States<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.middleeasteye.net\/news\/pro-palestinian-speech-suppressed-canada-new-report-shows\"><span style=\"font-weight: 400;\">Canada<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.theguardian.com\/australia-news\/2024\/oct\/16\/australia-cancels-visa-of-pro-palestine-academic-who-called-7-october-day-of-considerable-celebration\"><span style=\"font-weight: 400;\">Australia<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/dub.uu.nl\/en\/news\/pro-palestinian-lecture-moved-due-new-uu-rules\"><span style=\"font-weight: 400;\">the Netherlands<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/www.eurozine.com\/censure-the-crackdown-on-pro-palestinian-voices-in-france\/\"><span style=\"font-weight: 400;\">France<\/span><\/a><span style=\"font-weight: 400;\">, reflecting a trajectory parallel to that witnessed in the United Kingdom and Germany.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This raises the question of whether the integration of perspectives historically excluded from international legal discourse\u2014such as those of Palestinians\u2014can serve as the catalyst for a transformative shift in the field, prompting a re-evaluation of its foundational principles. Yet, this possibility remains uncertain. The broader and more pressing issue may be whether international legal thought requires fundamental restructuring, which would necessitate the deconstruction, dissection, and dismantling of its inherited canon, deeply rooted in a hegemonic, colonial, imperialist, and racist tradition of thought (<\/span><i><span style=\"font-weight: 400;\">cf.<\/span><\/i> <a href=\"https:\/\/opiniojuris.org\/2024\/10\/10\/rethinking-international-law-after-gaza-symposium-international-law-beneath-the-rubble-academic-complicity-in-gaza-genocide\/\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/academic.oup.com\/lril\/article-abstract\/12\/2\/217\/7723668?redirectedFrom=fulltext#483101770\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Against this background, this symposium builds on the work that has been conducted in relevant journal articles (e.g. <\/span><a href=\"https:\/\/academic.oup.com\/lril\/article-abstract\/12\/2\/217\/7723668?redirectedFrom=fulltext\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/1323238X.2024.2385504\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.tandfonline.com\/doi\/abs\/10.1080\/19436149.2024.2375918\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">), blogposts (e.g. <\/span><a href=\"https:\/\/opiniojuris.org\/2024\/10\/10\/rethinking-international-law-after-gaza-symposium-international-law-beneath-the-rubble-academic-complicity-in-gaza-genocide\/\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/academeblog.org\/2024\/06\/24\/gaza-genocide-and-academic-freedom\/\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">) and events (e.g. <\/span><a href=\"https:\/\/lselaw.events\/event\/academic-freedom-after-the-destruction-of-gazas-universities\/\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/as.nyu.edu\/research-centers\/neareaststudies\/events\/past-events\/fall-2022\/academic-freedom-and-palestinian-higher-education-under-settler-.html\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/iismm.hypotheses.org\/108448\"><span style=\"font-weight: 400;\">here<\/span><\/a><span style=\"font-weight: 400;\">), and invites scholars to share their experiences of restricted academic freedom in the context of the Palestinian occupation. These experiences, which often expose the pervasive silencing and marginalisation of pro-Palestinian voices, offer a unique lens through which to critically examine the structural biases embedded within international legal discourse. Participants are encouraged to reflect on how these constraints might not only highlight the enduring legacy of hegemonic, colonial, imperialist, and racist traditions in international law but also provide a basis for envisioning a radically restructured framework.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This approach resonates with the critiques of thinkers like <\/span><a href=\"https:\/\/www.google.de\/books\/edition\/Orientalism\/npF5BAAAQBAJ?hl=fr&amp;gbpv=1&amp;dq=edward+said+orientalism&amp;printsec=frontcover\"><span style=\"font-weight: 400;\">Edward Said<\/span><\/a><span style=\"font-weight: 400;\">, who interrogated the Eurocentric knowledge systems that sustain colonial power, and <\/span><a href=\"https:\/\/www.google.de\/books\/edition\/The_Wretched_of_the_Earth\/-XGKFJq4eccC?hl=fr&amp;gbpv=1&amp;dq=The+Wretched+of+the+Earth&amp;printsec=frontcover\"><span style=\"font-weight: 400;\">Frantz Fanon<\/span><\/a><span style=\"font-weight: 400;\">, who emphasised the systemic violence inherent in colonial structures. By drawing on the works of critical international legal scholars like <\/span><a href=\"https:\/\/www.degruyter.com\/document\/doi\/10.1515\/9780822383871-012\/html?lang=en&amp;srsltid=AfmBOoqBOpSH8GIEKAdcVSu7m1G8m_3mxqGAFZMIZjrut-viEnSTpsR4\"><span style=\"font-weight: 400;\">David Kennedy<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"https:\/\/www.cambridge.org\/core\/books\/gentle-civilizer-of-nations\/DB461DBE95F8A6E05A65438171E6B637\"><span style=\"font-weight: 400;\">Martti Koskenniemi<\/span><\/a><span style=\"font-weight: 400;\">, as well as feminist theorists such as <\/span><a href=\"https:\/\/jan.ucc.nau.edu\/~sj6\/Spivak%20CanTheSubalternSpeak.pdf\"><span style=\"font-weight: 400;\">Gayatri Chakravorty Spivak<\/span><\/a><span style=\"font-weight: 400;\">, the Symposium aims to examine how international law, often framed as neutral and universal, is implicated in perpetuating inequities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thus, the Symposium serves as both a platform to discuss the lived realities of academic restriction and a forum to explore the possibilities of an international legal discourse that transcends the constraints of its dark past, fostering a framework that prioritizes inclusivity, equity, and historical accountability. We thus invite contributors to reflect on the following general themes:\u00a0<\/span><\/p>\n<p><strong>1. Academic Freedom as a Pillar of Democratic Governance and the Rule of Law<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Academic freedom has traditionally stood as a foundational pillar of democratic governance and the rule of law, providing the intellectual space necessary for the pursuit of truth and the defence of fundamental rights and liberties. How do the restrictions outlined above affect the enjoyment of academic freedom and how compatible are such restrictions with a democratic society and the rule of law? What roles does academic freedom play in upholding fundamental rights and liberties? How does academic freedom interrelate with other fundamental rights and freedoms? What impact does the chilling effect caused by such restrictions have on human rights advocacy?\u00a0<\/span><\/p>\n<p><strong>2. Intersecting Struggles: The Global Nature of Systemic Oppression and Its Impact on International Law and Legal Academia<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">What impact do the aforementioned instances of academic freedom\u2019s restriction have on the expression of the voices of marginalised groups and the struggle for inclusion, polyphony, and TWAILing in academic discourse and international legal academia? How do such restrictions sustain existing biases and reinforce racism and <\/span><a href=\"https:\/\/academic.oup.com\/book\/32817\"><span style=\"font-weight: 400;\">epistemic injustice<\/span><\/a><span style=\"font-weight: 400;\"> in academia? How does enforced conformity in academic thinking affect the development of international law and legal thought? From an intersectional viewpoint, how does the systemic oppression of the Palestinian struggle shape and confine academic discourse? How does academic freedom enable or restrict Palestinian voice and agency?\u00a0 Could one consider the extensive damage and destruction of educational facilities in Gaza \u2013 including schools and universities \u2013 as an intentional effort to comprehensively destroy the Palestinian education system? In other words, could this be regarded as an act of <\/span><a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2024\/04\/un-experts-deeply-concerned-over-scholasticide-gaza\"><i><span style=\"font-weight: 400;\">\u2018scholasticide\u2019<\/span><\/i><\/a><span style=\"font-weight: 400;\">?<\/span><\/p>\n<p><strong>3. Academic Freedom in the Shadow of the Crossfire: Suppression, Silence, and Resistance\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">In light of the fact that the ICJ has been called upon to decide whether Israel\u2019s military actions amount to a genocidal campaign, with the potential for it to reach such a decision in the future, a heightened awareness of the ethical and intellectual responsibilities of academics during such times can be seen to be of particular importance. What is the role of academics and what are good academic practices under such circumstances? How does repression in Israel influence academic freedom in Europe, North America and beyond? Which are the distinguishing lines between criticism and censorship, and what are the risks of conflating anti-Zionism with antisemitism? How are suppression and <\/span><a href=\"https:\/\/www.jstor.org\/stable\/23016544\"><span style=\"font-weight: 400;\">practices of silencing<\/span><\/a><span style=\"font-weight: 400;\"> used in the global scene for the rewriting of historical narratives and for limiting pathways to justice and remembrance?
