An epitome of the decade\u2019s empty universalism and depoliticizing drift in the domain of \u2018global governance\u2019, \u2018rule of law reform\u2019 feels <a href=\"https:\/\/www.youtube.com\/watch?v=9hFdZRYZhkg\">very 90\u2019s<\/a> \u2013 like grunge, pagers or Windows 95. \u2018Many of us\u2019, John Haskell <a href=\"https:\/\/link.springer.com\/chapter\/10.1007\/978-94-6265-403-7_3\">writes<\/a>, \u2018find ourselves in the rule of law without knowing exactly how we ended up here or no longer feeling driven by the same motivations that we once experienced\u2019. This sounds like an understatement. A rationality of <a href=\"https:\/\/global.oup.com\/academic\/product\/to-reform-the-world-9780198757962\">international liberal reform<\/a>, an abstraction from <a href=\"https:\/\/salvage.zone\/the-right-against-the-rule-of-law\/\">material modes of production<\/a>, a reflection of hierarchical <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/13642987.2023.2227124\">modernist subject\/object dichotomies<\/a>, a project for <a href=\"https:\/\/www.e-elgar.com\/shop\/gbp\/gender-alterity-and-human-rights-9781839104473.html\">containment and control of subaltern subjects<\/a>, a <a href=\"https:\/\/www.cambridge.org\/core\/books\/abs\/decolonising-international-law\/development-and-the-rule-of-international-law\/73C9E34DC6C474D292F64EF41ECDDE00\">fig leaf<\/a> for long historical lineages of Western hegemony, (neo)colonial violence and resource extraction \u2013 the international \u2018rule of law\u2019 and the liberal order it produces have been key targets of critical scholarship. When facing contemporary genocidal violence, invocations of this \u2018rule of law\u2019 \u2013 in <a href=\"https:\/\/criticallegalthinking.com\/2024\/05\/14\/cfp-epistolary-international-law\/\">epistolary<\/a> or other forms \u2013 then evidently seem <a href=\"https:\/\/criticallegalthinking.com\/2024\/04\/02\/international-law-and-failure-in-the-context-of-gaza\/\">insufficient<\/a> and <a href=\"https:\/\/criticallegalthinking.com\/2024\/02\/19\/the-uses-of-marxist-theory-of-law-during-a-genocide\/\">half-hearted<\/a> (\u2018we know the law can\u2019t save us, but\u2026\u2019). Yet, they often appear <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/01436597.2016.1209971\">inevitable<\/a> when confronted with the realities of social mobilisation and resistance (\u2018if you don\u2019t do international law, international law will do you\u2019). And so, around and around we go in oscillations between the <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=1921759\">tactical and the strategic<\/a>, in the enduring Groundhog Day of division and discontent.<\/p>\n<p>If you recognize this sense of being stuck, Michelle Staggs Kelsall\u2019s rich and inspiring \u2018<a href=\"https:\/\/academic.oup.com\/ejil\/article\/33\/3\/729\/6770704\">Disordering International Law<\/a>\u2019 will speak to you and stay with you. In a register that verges on the therapeutic, Michelle draws the contours of a critical consciousness \u2013 a \u2018disordering sensibility\u2019 \u2013 that enables a shift from disappointment and disavowal to change and renewal. Its diagnosis? A compulsion in critical work to (re)turn to the liberal international legal order as an analytical reference point. There is a resonance here with Ben Golder\u2019s <a href=\"https:\/\/academic.oup.com\/lril\/article\/2\/1\/77\/950264\">critique<\/a> on the redemptive structure of critical human rights scholarship, yet also a move beyond it: the problem, for Michelle, is not the latent reification of or return to the emancipatory promises of liberal international law but an apparent inability to \u2018jettison it altogether\u2019 as an authoritative map of the world in which to intervene (731). This is a profound and radical argument on international law\u2019s performative power \u2013 on how subjects are enacted and lines of mattering or worlding are drawn (and can be redrawn) in its operations. Part of the violence of the liberal international legal order then lies in the world it has on offer \u2013 a series of ontological hierarchies and cuts that critical work, Michelle argues, tends to replicate or reproduce (753-754).<\/p>\n<p><strong>The Critical Longing for Disorder<\/strong><\/p>\n<p>Its remedy? Multiplication, decentralisation, disordering \u2013 a plea to attend to the plurality of \u2018spatial and temporal orders\u2019 in the interstices of the international (729, 731-732, 745). This \u2018disordering sensibility\u2019 promises to enrich the existing critical repertoire by providing an affirmative vision of international legal pluralism in spatial, temporal and subjective terms. It is a vision where, inspired by <a href=\"https:\/\/www.e-elgar.com\/shop\/gbp\/gender-alterity-and-human-rights-9781839104473.html\">Ratna Kapur\u2019s notion of non-dualist subjectivity<\/a>, the binary codes of modern international law are broken and where \u2018freedom [is] delinked from the state\u2019 (verging towards trending <a href=\"https:\/\/www.thenation.com\/article\/archive\/barbarian-virtues\/\">debates<\/a> on forms of freedom prior to the modern state sparked by <a href=\"https:\/\/yalebooks.yale.edu\/book\/9780300240214\/against-the-grain\/\"><em>Against the Grain<\/em><\/a> and <a href=\"https:\/\/us.macmillan.com\/books\/9780374157357\/thedawnofeverything\"><em>The Dawn of Everything<\/em><\/a>). It is an opening towards temporalities and subjectivities lingering in the <a href=\"https:\/\/www.qmul.ac.uk\/ihss\/whats-on\/underworlds--sites-and-struggles-of-global-disordering\/\"><em>underworlds<\/em><\/a> of international law and always at risk of erasure \u2013 from the \u2018alternative temporal universalisms\u2019 (742) instantiated by the Aboriginal concept of \u2018The Dreaming\u2019 to the subjectivities of land (<em>djang<\/em>) as a \u2018source of the law\u2019 (755-756). Throughout, Michelle\u2019s disordering sensibility invites Indigenous and non-Western epistemologies to suspend and disrupt international law\u2019s key concepts and categories \u2013 an <a href=\"https:\/\/www.cambridge.org\/core\/journals\/american-journal-of-international-law\/article\/customary-international-law-a-third-world-perspective\/DEDB6DB43A3B5A613B68FDBE56E20A20\"><em>opinio juris communis<\/em><\/a> of spatio-temporal multiplicity, relational entanglement and epistemic pluralism.<\/p>\n<p>In a sense, \u2018<a href=\"https:\/\/academic.oup.com\/ejil\/article\/33\/3\/729\/6770704\">Disordering International Law<\/a>\u2019 guides us along <a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/abs\/10.1111\/1468-2230.12442\">familiar critical routes<\/a>. Dissatisfied with the reductive modernist maps of liberal order, it leads where a critical canon has long led us: to the experimental and disruptive, the multiple and deterritorialized, the decentralised and disordered, the <a href=\"https:\/\/www.cambridge.org\/core\/books\/local-space-global-life\/512D553CE9BAAA5498B85F911111CD90\">local<\/a>, <a href=\"https:\/\/rowman.com\/ISBN\/9781786605719\/Becoming-Indigenous-Governing-Imaginaries-in-the-Anthropocene\">indigenous<\/a> and <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3957533\">out of place<\/a>. In its suspension of either\/or binaries, we hear a resonance of Deleuze\u2019s <a href=\"https:\/\/cup.columbia.edu\/book\/difference-and-repetition\/9780231081597\"><em>Difference and Repetition<\/em><\/a><em> \u2013 <\/em>a negation of oppositional codes in favour of unscripted <a href=\"https:\/\/files.libcom.org\/files\/A%20Thousand%20Plateaus.pdf\">lines of flight<\/a> and emergent relational compositions of being and becoming. In its aspiration for non-dualist freedom, there is an echo of the <a href=\"https:\/\/warwick.ac.uk\/fac\/arts\/english\/currentstudents\/undergraduate\/modules\/fictionnownarrativemediaandtheoryinthe21stcentury\/manifestly_haraway_----_a_cyborg_manifesto_science_technology_and_socialist-feminism_in_the_....pdf\">cyborg<\/a>\u2019s \u2018spiral dance\u2019 celebrated by Haraway as a promised pathway out of the \u2018maze of dualisms\u2019 imposed by conditions of liberal modernity. In its focus on relationality and more-than-human agency \u2013 the law <em>within<\/em> the land \u2013 there is a critical affinity with registers of entanglement and an opening to the <a href=\"https:\/\/academic.oup.com\/lril\/article\/11\/2\/197\/7284183?login=false\">multiple materialisms<\/a> of international law \u2013 to the \u2018morass of worlds colliding\u2019 (756). This direction toward disorder has a latent philosophical lineage \u2013 \u2018[t]here are the builders of systems, the architects of enclosure and addicts of totality\u2019, George Steiner <a href=\"https:\/\/ia802703.us.archive.org\/27\/items\/SteinerGeorge_201504\/Steiner%2C%20George%20-%20Poetry%20of%20Thought%20from%20Hellenism%20to%20Celan%20%28New%20Directions%2C%202011%29.pdf\">reflects<\/a> in <em>The Poetry of Thought<\/em>, \u2018[a]nd there are the raiders, often solitary, on meaning and the world, the technicians of lightning striking as it were from the periphery\u2019. Histories of modern thought based on the \u2018presumption of articulate order in reality\u2019 are shadowed by this \u2018sense of the fractured, possibly random tenor of the phenomenal\u2019 \u2013 a \u2018disordering sensibility\u2019 that, as Michelle\u2019s piece shows, lends itself perfectly to a move beyond the inhibiting enclosures of liberal legal order. What would international law look like if not designed and called upon by \u2018architects of enclosure\u2019? In framing this question, Michelle has enriched and redirected the field of critical international law.<\/p>\n<p><strong>The Disordering Sensibilities of Neoliberalism<\/strong><\/p>\n<p>And yet, while nodding along the lines of Michelle\u2019s evocative piece, I can\u2019t shake the sense that I might be in awkward company. Why the discomfort with disorder? In reflecting on <a href=\"https:\/\/www.dukeupress.edu\/between-gaia-and-ground\">the social tense of this critical repertoire<\/a> at the current conjuncture \u2013 how it exists and performs within the world today \u2013 it is useful to pause at the remarkable titular return of \u2018disorder\u2019 in an article published only a few <em>EJIL<\/em> issues later: Andrew Lang\u2019s \u2018<a href=\"https:\/\/academic.oup.com\/ejil\/article\/35\/1\/93\/7632077\">Global Disordering<\/a>\u2019. Diagnosing the workings of \u2018disorder\u2019 in a different register, Andrew argues that the neoliberal project (a critical target in Michelle\u2019s piece) should not be understood \u2013 at least not exclusively \u2013 as a programmatic universal order of optimal state-market relationships but rather as a \u2018set of techniques for displacing the question of social value\u2019 in relation to the \u2018disenchantment or desacralization of the social state\u2019. Neoliberalism, he notes, can thereby be seen as a \u2018mode of governmentality \u2026 for addressing the specific pathologies of the social state by promising a modality of statecraft that [is] decentralized rather than subject to singular control; dynamic rather than rigid and inflexible; open-ended rather than narrowly teleological; and modest rather than hubristic in its claims to knowledge\u2019 (<a href=\"https:\/\/doi.org\/10.1093\/ejil\/chae011\">Lang<\/a>, 2024, 108). This is not the universalist, rational \u2018rule of law\u2019 that Michelle\u2019s piece works against (731). Neoliberalism, from this perspective, is marked precisely by a series of governance technologies designed to trade the rigid values-oriented modes of international legal ordering for a competitive process defined by sensibilities of disenchantment and disorder \u2013 described by Michelle as central to critique (754). Not all in the \u2018critical\u2019 community will find themselves entirely at ease in the social state that figures as implicit normative benchmark of Andrew\u2019s argument, but the dynamics of disenchantment and disordering that the piece so carefully traces are undoubtedly disconcerting and familiar.<\/p>\n<p>This is what I observed in <a href=\"https:\/\/global.oup.com\/academic\/product\/the-world-banks-lawyers-9780192846495?facet_narrowbybinding_facet=Ebook&amp;lang=en&amp;cc=us\">my own empirical work<\/a> on the <a href=\"https:\/\/voelkerrechtsblog.org\/symposium\/the-world-banks-lawyers\/\">World Bank<\/a>: how the rigid formal order of the \u2018rule of law\u2019 was traded for a <a href=\"https:\/\/www.tandfonline.com\/doi\/full\/10.1080\/20414005.2020.1825036\">\u2018new normative architecture\u2019<\/a> of risk and resilience productively attuned to conditions of uncertainty. It is on the terrain of professional sensibility, indeed, that this change was enacted: international lawyers were no longer expected to loyally stick to the binary codes of legal ordering but to enhance their \u2018<a href=\"https:\/\/academic.oup.com\/ejil\/article\/34\/1\/141\/7147219?login=false\">risk appetite<\/a>\u2019 and target the \u2018transformational rewards\u2019 that a more dynamic, decentralised, deformalized, disorderly professional posture could offer. It is the ability to capitalise on <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3469325\">contingency<\/a> through a heightened \u2018disordering sensibility\u2019 \u2013 and not the commitment to ordo-liberal restraint \u2013 that seems to mark the neoliberal condition (and its impact on international law). In this light, the diagram of dichotomies between <em>order<\/em> (liberal, universalist, dualist, reductive) and <em>disorder<\/em> (experimental, pluralist, non-dualist, emancipatory) might not have the critical power it once had. (This is a variation on wider reflection on <a href=\"http:\/\/www.bruno-latour.fr\/sites\/default\/files\/89-CRITICAL-INQUIRY-GB.pdf\">why critique has run out of steam<\/a> in social theory in general and in relation to <a href=\"https:\/\/link.springer.com\/journal\/10978\/volumes-and-issues\/33-3\">critical international law<\/a> in particular). There is a remarkable and perhaps telling evolution, in this sense, between Slobodian\u2019s <a href=\"https:\/\/www.hup.harvard.edu\/books\/9780674244849\"><em>Globalists<\/em><\/a> \u2013 on the ordo-liberal structure of post-imperial capitalist relations \u2013 and his recent of <a href=\"https:\/\/www.londonreviewbookshop.co.uk\/stock\/crack-up-capitalism-market-radicals-and-the-dream-of-a-world-without-democracy-quinn-slobodian\"><em>Crack-Up Capitalism<\/em><\/a> \u2013 which could be read as an analysis of the dreamscapes of disorder and the departure from the state that shape contemporary (anarcho-)capitalist practices, aspirations and experiments.<\/p>\n<p><strong>Critical Complicities (In a World of Disorder)<\/strong><\/p>\n<p>This also connects to the vision of freedom that inspires Michelle\u2019s argument \u2013 a freedom that is \u2018delinked from the state\u2019 (755). The piece provides a powerful affirmative vision of this non-dualist freedom prior or in parallel to modern statehood, which draws on the knowledge of Indigenous communities and those written out of the world of international law (a move that is always at risk of <a href=\"https:\/\/rowman.com\/ISBN\/9781786605719\/Becoming-Indigenous-Governing-Imaginaries-in-the-Anthropocene\">instrumentalising<\/a> Indigeneity in neoliberal schemes of resilience). Yet, it is surely not only in the realm of Indigenous activism that this \u2018disordering sensibility\u2019 of \u2018delinking\u2019 freedom from the state has taken root. It is a vision also animating the (anti-)politics of tech libertarians such as Peter Thiel who, <a href=\"https:\/\/link.springer.com\/article\/10.1007\/s10978-022-09327-0\">convinced<\/a> of the incompatibility of democracy and freedom, set out to explore \u2018<a href=\"https:\/\/www.cato-unbound.org\/2009\/04\/13\/peter-thiel\/education-libertarian\/\">new space[s] for freedom<\/a>\u2019 \u2013 an exploration of \u2018new frontiers\u2019 that guides Thiel and his allies to cyberspace, <a href=\"https:\/\/www.taylorfrancis.com\/chapters\/edit\/10.4324\/9781003170914-27\/space-way-go-cait-storr\">outer space<\/a>, and the oceanic spaces of <a href=\"https:\/\/www.cambridge.org\/core\/journals\/leiden-journal-of-international-law\/article\/seasteads-landgrabs-and-international-law\/707B06407F825275DBAF346A8B3D1751\">seasteading<\/a>. Technologies of this \u2018delinking\u2019 are now seen to be available with the jurisdictional possibilities of blockchain enabling <a href=\"https:\/\/link.springer.com\/article\/10.1007\/s10978-022-09327-0\"><em>cryptosecession<\/em> and <em>cryptostatecraft<\/em><\/a> \u2013 a revolutionary freedom of exit and political experimentation. Surely these are not the lines of flight that Michelle\u2019s article seeks to inspire but there is an eerie resonance across these projects of \u2018disordering\u2019: is the aspiration of seasteading not precisely to multiply and pluralise spatio-temporal orders in the interstices of the international and beyond the reach of sovereign states? Many of the arteries of power that we traced in the <a href=\"https:\/\/www.qmul.ac.uk\/ihss\/whats-on\/underworlds--sites-and-struggles-of-global-disordering\/\">underworlds series<\/a>, in this sense, indeed emerged disorderly from the multiplicity of spatio-temporal orders \u2013 from the shadows of sovereignty and statehood.<\/p>\n<p>Similar ambiguities arise in relation to questions of legal subjectivity. Michelle\u2019s piece criticizes the narrow binary categories through which liberal forms of legal ordering enact and rank subjects. It provides a powerful indictment of the \u2018normative coercions of subject formation\u2019 (736) that are at the core of international law\u2019s classificatory operations and have been the target of varying strands of postcolonial, posthumanist and new materialist critique. Yet, with the expanding prevalence of (global) <a href=\"https:\/\/www.annualreviews.org\/content\/journals\/10.1146\/annurev-lawsocsci-120920-085138\">governance by data<\/a>, subjects are increasingly composed more as <a href=\"https:\/\/journals.sagepub.com\/doi\/10.1177\/2053951720969208\">fluid inferences, patterns and propensities<\/a> than as unitary abstractions of individual agency and autonomy. In my own work on <a href=\"https:\/\/academic.oup.com\/ejil\/article\/33\/1\/171\/6583470\">virtual borders<\/a>, and in collaboration with Marie Petersmann, we reflected on this recomposition of subjects as emergent <a href=\"https:\/\/link.springer.com\/article\/10.1007\/s00146-023-01728-8\">clusters of inferred attributes<\/a> \u2013 pulsing patterns in curated flows of data. To insist on the disordering of liberal subject categories \u2013 as \u2018bounded entit[ies] with fixed markers\u2019 (736) \u2013 risks reinforcing precisely these emergent and troubling entities of algorithmic governance. When the floor of liberal subjectivity falls from under our feet, we might not find ourselves dancing the \u2018spiral dance of the cyborg\u2019 but dissipate instead into the transient collectivity of the cluster. None of this is set in stone, of course, but it raises the stakes of critical strategies and complicities.<\/p>\n<p>In many spheres of global governance, promises of universal value, stable spatial delineation, linear temporality, systemic ordering or rigid legal classification along formally unfolding binaries belong \u2013 in certain significant ways \u2013 to the world of yesterday. The practices of global security governance on which my current work <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4759300\">focuses<\/a>, in this sense, are not marked by the \u2018systemic function or neat arrangement of legal ordering\u2019 (758) that Michelle invites us to \u2018disrupt\u2019 but by a logic of emergent inferences, fragmented spatial compositions, speculative temporalities and fluid subject positions. Might it be that the \u2018liberal protocols\u2019 (731) foregrounded in critical scholarship thereby no longer wield the authority they once did? That the classical nemeses of critique which return in Michelle\u2019s article \u2013 the state, the \u2018rule of law\u2019, the truth, the universal \u2013 have lost their performative power (at least to some extent)? Might it be that <a href=\"https:\/\/journals.sagepub.com\/doi\/abs\/10.1177\/0305829815576817\">critical moves<\/a> <a href=\"https:\/\/onlinelibrary.wiley.com\/doi\/abs\/10.1111\/1468-2230.12442\">have been metabolized<\/a> in current governance routines? How to engage, in short, with what can be described as contemporary <em>governmentalities of disorder<\/em>? Would a \u2018disordering sensibility\u2019 not amplify those operations already underway?<\/p>\n<p><strong>Multiplying and Materialising International Law<\/strong><\/p>\n<p>To be clear: none of this implies that the terrain of \u2018disorder\u2019 has irreversibly been rendered toxic or that only a return to the stable concepts and subject categories of international law can protect us. Yet, it does, in my view, mean three things. First, there is nothing inherently progressive, safe, critical or desirable in a \u2018disordering sensibility\u2019. The orientation towards either order or disorder is politically and ideologically indeterminate. Second, and building on this, I think we should remain attentive to the ordering capacities of disorder \u2013 the constant movements from <a href=\"https:\/\/files.libcom.org\/files\/A%20Thousand%20Plateaus.pdf\">deterritorialization to reterritorialization<\/a> \u2013 and how power and resources are distributed in this process. This is where Michelle\u2019s piece articulates perhaps its most powerful political claim: in its plea for a redistribution of power away from international law\u2019s \u2018architects of enclosure\u2019 to locally affected communities, it articulates a bold vision of disordering as an invigorated <em>opinio juris communis<\/em>. Yet, in facing forms of seasteading and cryptostatecraft \u2013 the neoliberal order of disorder \u2013 a (re)assertion of collective political agency might hinge on the institutional levers and jurisdictional schemes of statehood that a \u2018disordering sensibility\u2019 aspires to unravel. In relation to these distributive stakes in a context of indeterminacy, any <em>a priori<\/em> commitment to a logic of disordering can, in my view, only be aesthetic. Third, inspired by and building on Michelle\u2019s refusal \u2018to frame any new, alternative grand narrative for international law\u2019 (732), expanding the \u2018imaginative possibilities of critique\u2019 (733) might require radically decentring (international) law and tracing how its institutions, norms and principles are <a href=\"https:\/\/www.jstor.org\/stable\/41350304\">metabolised in emergent governmental <em>dispositifs<\/em><\/a> \u2013 from the <a href=\"https:\/\/www.cambridge.org\/core\/journals\/american-journal-of-international-law\/article\/abs\/data-detection-and-the-redistribution-of-the-sensible-in-international-law\/A8D1084FBA9EA2600067D9E1B2542909\">sensory economies<\/a> of <a href=\"https:\/\/www.e-flux.com\/architecture\/accumulation\/217051\/becoming-planetary\/\">environmental modelling<\/a> or <a href=\"https:\/\/global.oup.com\/academic\/product\/help-9780197648872?cc=ro&amp;lang=en&amp;\">digital humanitarianism<\/a> to the <a href=\"https:\/\/www.dukeupress.edu\/the-politics-of-possibility\">politics of possibility<\/a> that mediate practices of <a href=\"https:\/\/www.cambridge.org\/core\/books\/law-of-the-list\/DED06F90A3949ED4006DC2DA51A46DDF\">security<\/a> and <a href=\"https:\/\/papers.ssrn.com\/abstract=4759300\">surveillance<\/a>.
