{"id":22240,"date":"2024-05-16T08:00:38","date_gmt":"2024-05-16T06:00:38","guid":{"rendered":"https:\/\/voelkerrechtsblog.org\/?p=22240"},"modified":"2024-05-17T10:51:56","modified_gmt":"2024-05-17T08:51:56","slug":"crossfire-commerce","status":"publish","type":"post","link":"https:\/\/voelkerrechtsblog.org\/de\/crossfire-commerce\/","title":{"rendered":"Crossfire Commerce"},"content":{"rendered":"<p>The ongoing conflict in Gaza has drawn in numerous foreign actors and impacted trade, leading to proposed trade sanctions against parties like <a href=\"https:\/\/www.timesofisrael.com\/belgian-pm-says-he-is-rallying-eu-countries-to-impose-trade-sanctions-on-israel\/\">Israel<\/a> (such as <a href=\"https:\/\/www.timesofisrael.com\/turkeys-trade-ban-importers-seek-indirect-routes-to-bring-goods-to-israel\/\">Turkey\u2019s trade ban<\/a>), <a href=\"https:\/\/www.bbc.com\/news\/world-middle-east-68832045\">Iran<\/a>, and <a href=\"https:\/\/www.aljazeera.com\/news\/2023\/11\/14\/us-announces-third-round-of-sanctions-targeting-hamas\">Palestinian groups<\/a>. As several of those parties are <a href=\"https:\/\/www.wto.org\/english\/thewto_e\/whatis_e\/tif_e\/org6_e.htm\">WTO members<\/a>, they might challenge the restrictions under WTO law. In turn, the respondents would invoke the \u2018security exception\u2019 in <a href=\"https:\/\/www.wto.org\/english\/docs_e\/legal_e\/gatt47_02_e.htm#articleXXI\">Article XXI of the GATT 1994<\/a>. This provision allows a state to bypass WTO obligations and take measures \u201cwhich it considers necessary\u201d to protect its security interests during wars and international emergencies. The WTO\u2019s handling of the <a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">Russia-Ukraine transit dispute<\/a> \u2013 the only WTO case to extensively explore this exception to date \u2013 highlights the challenges in interpreting it. This blogpost considers the WTO Panel\u2019s approach and its potential implications for adjudicating security exceptions in Middle Eastern conflicts.<\/p>\n<p><strong>WTO Panel Analysis: Russia-Ukraine Transit Dispute and Article XXI Interpretation<\/strong><\/p>\n<p>In response to international sanctions imposed due to Russia\u2019s annexation of Crimea and invasion of the eastern part of Ukraine, Russia restricted the transit of Ukrainian goods, invoking Article XXI of the GATT for justification. On the one hand, the WTO Panel clarified that Article XXI is not entirely self-judging, as Russia had claimed (<a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">ibid<\/a>., para 7.26). According to the Panel, the term \u201cwhich it considers\u201d simply modifies \u201cnecessary,\u201d while specific scenarios like wars or emergencies restrict member discretion (<a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">ibid<\/a>., para 7.101). Further, the Panel stated that determining an \u201cemergency in international relations\u201d can be objectively evaluated (<a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">ibid<\/a>., para 7.77). On the other hand, it introduced a \u2018minimum plausibility\u2019 standard to link the measure with the security interests it purportedly protects (<a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">ibid<\/a>., para 7.138), establishing an extremely low threshold for justification. Ultimately, the Panel ruled that Russia\u2019s measures satisfied this criterion, making Ukraine\u2019s GATT claims on material law redundant and absolving Russia from liability (<a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">ibid<\/a>., para 7.148).<\/p>\n<p><strong>Criticism of the Panel\u2019s Reasoning: Muddying the Burden of Proof?<\/strong><\/p>\n<p>The WTO Panel\u2019s approach has sparked criticism for its lenient evidence standards. Russia justified its 2014 trade restrictions by vaguely referring to an \u201cemergency in international relations,\u201d without specific details. It merely referred to \u201can emergency in international relations that had taken place sometime in 2014, which was the reason Russia took various actions, like declaring the measures at issue\u201d (<a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">ibid<\/a>., para 7.112). In response, the Panel, lowering the burden of proof, suggested that states need not fully characterize such emergencies (<a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">ibid<\/a>., para 7.121), raising <a href=\"https:\/\/www.lakshmisri.com\/insights\/articles\/all-is-fair-in-trade-and-war-panel-ruling-on-interpretation-of-security-exceptions-in-russia-traffic-in-transit\/\">concerns<\/a> that this could lead to the justification of arbitrary trade restrictions.<\/p>\n<p>Critics <a href=\"http:\/\/www.qil-qdi.org\/the-wto-panel-report-in-russia-traffic-in-transit-cutting-the-gordian-knot-of-the-gatt-security-exception\/\">argue<\/a> that this leniency might encourage states to artificially create emergencies to impose trade barriers. This issue is compounded by the Panel\u2019s assertion that the responsibility for causing the emergency is irrelevant (<a href=\"https:\/\/docs.wto.org\/dol2fe\/Pages\/SS\/directdoc.aspx?filename=q:\/WT\/DS\/512R.pdf&amp;Open=True\">para 7.121<\/a>). Here, scholars have <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=2695936\">noted<\/a> that the clean hands doctrine should be introduced within WTO Dispute Settlement mechanisms to prevent states from exploiting the Article XXI exception to their benefit.<\/p>\n<p>Additionally, the Panel sided with Russia\u2019s arguments despite scant factual evidence, <a href=\"https:\/\/www.cambridge.org\/core\/journals\/world-trade-review\/article\/separating-the-political-from-the-economic-the-russiatraffic-in-transit-panel-report\/97C7F7F3BAD44B9F4B7C392CA5657FE1\">blending<\/a> protections from Article XXI(a) \u2013 which shields states from revealing sensitive information \u2013 with Article\u00a0XXI(b)\u2019s permissions for actions protecting security interests. This conflation led to concerns about the Panel\u2019s role in assuming the burden of proof, primarily using evidence from Ukraine rather than Russia\u2019s submissions. Highlighting this issue, Van Damme <a href=\"https:\/\/global.oup.com\/academic\/product\/the-oxford-handbook-of-international-trade-law-9780192868381?cc=us&amp;lang=en&amp;\">argues<\/a> that \u201cat least some evidence should be provided\u201d while invoking the Article XXI(a) exception \u2013 even if the evidence \u201cexplains the nature of the withholding of evidence\u201d.<\/p>\n<p>Moreover, <a href=\"https:\/\/www.ejiltalk.org\/the-wto-panel-ruling-on-the-national-security-exception-has-the-panel-cut-the-baby-in-half\/#more-17087\">some scholars<\/a> believe that the Panel in <em>Russia-<\/em>Transit \u201ccut the baby in half\u201d, by allowing Russia to claim the exception while also acknowledging an \u201cemergency in international relations,\u201d which would aid Ukraine in challenging Russia\u2019s <a href=\"https:\/\/www.wto.org\/english\/tratop_e\/dispu_e\/cases_e\/ds525_e.htm\">subsequent<\/a> trade measures.<\/p>\n<p>Despite many <a href=\"https:\/\/www.lakshmisri.com\/insights\/articles\/all-is-fair-in-trade-and-war-panel-ruling-on-interpretation-of-security-exceptions-in-russia-traffic-in-transit\/\">critiques<\/a>, subsequent WTO cases have adopted the Panel\u2019s interpretation of Article XXI, indicating broader acceptance within the WTO framework. Examples include cases involving Saudi Arabia, the United States concerning steel and aluminium, and the US origin marking requirements, which all reference the analytical framework established in the Russia-Transit decision (see <em>Saudi Arabia: Measures concerning the Protection of Intellectual Property Rights<\/em>\u2013<a href=\"https:\/\/www.wto.org\/english\/tratop_e\/dispu_e\/cases_e\/ds567_e.htm\"><em>Panel Report<\/em><\/a>, paras. 7.243-7.255, 7.271; <em>United States: Certain Measures on Steel and Aluminium Products<\/em>\u2013<a href=\"https:\/\/www.wto.org\/english\/tratop_e\/dispu_e\/cases_e\/ds548_e.htm\"><em>Panel Report<\/em><\/a>, para. 7.128; and <em>United States: Origin Marking Requirement<\/em>\u2013<a href=\"https:\/\/www.wto.org\/english\/tratop_e\/dispu_e\/cases_e\/ds597_e.htm\"><em>Panel Report<\/em><\/a>, para. 7.185). This development suggests that states involved in Middle East conflicts could use lower thresholds to justify trade measures under the guise of security.<\/p>\n<p><strong>Panel\u2019s Findings at the International Law Background<\/strong><\/p>\n<p>The WTO Panel\u2019s handling of security exceptions in the Russia-Transit case, contrasts with the International Court of Justice\u2019s (ICJ) approach, as seen in <a href=\"https:\/\/www.mpil.de\/files\/pdf2\/03_schillbriese.pdf\">several cases<\/a> involving self-judging clauses, particularly the recent <a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/164\/164-20230330-JUD-01-00-EN.pdf\"><em>Certain Iranian Assets<\/em><\/a> decision. In that case, the ICJ interpreted a similarly worded security exception provision, namely Article XX(1)(d) of the Iran-US Treaty of Amity (<a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/164\/164-20230330-JUD-01-00-EN.pdf\">Judgment of 30 March 2023<\/a>, para\u00a096). While the WTO allowed a low threshold for invoking security exceptions, the ICJ required the U.S. to substantiate how its actions met the security exception criteria in the Iran-US Treaty of Amity, concluding that the U.S. failed to do so (<a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/164\/164-20230330-JUD-01-00-EN.pdf\">ibid<\/a>., para 108). Notably, in his Separate Opinion, Judge Iwasawa <a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/164\/164-20230330-JUD-01-09-EN.pdf\">discussed<\/a> the necessity tests applied by the ICJ and the WTO, favoring less stringent standards for security exceptions to avoid compromising national security.<\/p>\n<p><strong>Conclusion <\/strong><\/p>\n<p>Ultimately, the WTO allows considerable deference to state authorities in determining security risks and necessary measures. This deference is overseen by a \u2018good-faith review\u2019 to prevent abuse, yet the existing framework significantly favors state discretion over stringent international scrutiny, potentially facilitating the justification of trade measures on the grounds of national security in conflict situations like those in the Middle East.<\/p>\n<p>The threshold for invoking these exceptions remains low, enabling states to implement trade restrictions for non-trade objectives relatively unchallenged. This situation highlights that WTO is ill-equipped to balance trade and security interests. The ongoing <a href=\"https:\/\/www.wto.org\/english\/tratop_e\/dispu_e\/appellate_body_e.htm\">impasse<\/a> of the Appellate Body compounds this issue, making it unlikely that any future rulings will contradict the established Panel Report.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The ongoing conflict in Gaza has drawn in numerous foreign actors and impacted trade, leading to proposed trade sanctions against parties like Israel (such as Turkey\u2019s trade ban), Iran, and Palestinian groups.
