{"id":16789,"date":"2022-03-15T08:00:41","date_gmt":"2022-03-15T07:00:41","guid":{"rendered":"https:\/\/voelkerrechtsblog.org\/?p=16789"},"modified":"2022-03-15T15:53:15","modified_gmt":"2022-03-15T14:53:15","slug":"the-weaponisation-of-international-law-in-ukraine","status":"publish","type":"post","link":"https:\/\/voelkerrechtsblog.org\/de\/the-weaponisation-of-international-law-in-ukraine\/","title":{"rendered":"The Weaponisation of International Law in Ukraine"},"content":{"rendered":"<p>A provocative feature of Russia\u2019s invasion of Ukraine has been <a href=\"https:\/\/undocs.org\/S\/2022\/154\">invocation by Russian officials<\/a> of the legal language of \u201csovereignty\u201d, \u201cself-defence\u201d, \u201cgenocide\u201d and of \u201cinternational law\u201d itself. In tactical terms, Russia is engaged in a form of <a href=\"https:\/\/www.pennstatelawreview.org\/the-forum\/lawfare-both-an-existential-threat-to-the-international-rule-of-law-and-an-indispensable-tool-of-american-foreign-policy-in-the-twenty-first-century\/\">\u201clawfare\u201d<\/a>, in which the target audience\u2019s commitment to rule of law values is being exploited for military advantage. Misinformation success does not require that Russia convince its critics with a robust legal case, but only that its <a href=\"http:\/\/opiniojuris.org\/2022\/03\/07\/thou-shalt-not-distort-the-language-of-international-law\/\">inchoate tangle<\/a> of technical legal doctrines frustrate clear condemnation of illegal conduct. Yet these idiosyncratic legal claims should not distract from their deeper strategic coherence when read in the context of ongoing <a href=\"http:\/\/en.kremlin.ru\/supplement\/5770\">Sino-Russian attempts<\/a> to redefine the most basic rules and values of international law. Legal experts have worked to combat the weaponisation of law by Russia, but much broader political participation will be needed to preserve a global legal order that universally condemns the kind of violence being inflicted on Ukraine and its people.<\/p>\n<p>The illegality of Russia\u2019s invasion has been established beyond any reasonable doubt by international law scholars and practitioners, which includes foremost contravening <a href=\"https:\/\/www.lawfareblog.com\/putin-cant-destroy-international-order-himself\">prohibitions on the use of force<\/a> enshrined in the UN Charter, the <a href=\"https:\/\/www.ejiltalk.org\/aggression-against-ukraine-avenues-for-accountability-for-core-crimes\/\">crime of aggression<\/a> and <a href=\"https:\/\/theconversation.com\/civilians-are-being-killed-in-ukraine-so-why-is-investigating-war-crimes-so-difficult-178155\">war crimes<\/a>. Likewise, the strands of legalistic rhetoric used to defend Russian actions have been comprehensively refuted as they relate to claims of <a href=\"https:\/\/www.lawfareblog.com\/international-law-and-russian-invasion-ukraine\">preventing genocide<\/a> against Russian speaking people, <a href=\"https:\/\/www.ejiltalk.org\/recognition\/\">self-determination and unilateral recognition<\/a> of the Luhansk and Donetsk regions of Ukraine and justifications of <a href=\"https:\/\/lieber.westpoint.edu\/russia-special-military-operation-claimed-right-self-defense\/\">\u201cself-defence\u201d<\/a>. Clear and precise legal rebuttal is crucial for undermining Russian lawfare, but answering the bigger struggle over the very concept and purpose of international law requires a comprehensive response that transcends legal discourse.<\/p>\n<p><strong>The Russia-China Joint Statement on International Relations Entering a New Era<\/strong><\/p>\n<p>Conflicting international law claims in Ukraine are symptomatic of an era in which geopolitical fault lines are increasingly translating into <a href=\"https:\/\/law.unimelb.edu.au\/__data\/assets\/pdf_file\/0005\/4061939\/Jorgensen-advance-copy.pdf\">fragmented interpretations<\/a> of the most basic rules and values of global legal order. On 4 February 2022, Russia and China released a \u201c<a href=\"http:\/\/en.kremlin.ru\/supplement\/5770\">Joint Statement<\/a>\u201d that serves as a manifesto for what the states describe as \u201cInternational Relations Entering a New Era\u201d. In substantive terms, this is a vision for a more <a href=\"https:\/\/www.journalofdemocracy.org\/articles\/how-authoritarians-use-international-law\/\">\u201cauthoritarian international law\u201d<\/a>, which has long been evident in attempts to <a href=\"https:\/\/www.lowyinstitute.org\/the-interpreter\/china-overturning-rules-based-order-within\">remake<\/a> global institutions and treaty regimes in their own image. What is new, is that this process is no longer limited to repurposing rules and institutions, but extends to redefining the most foundational of legal and political concepts. The Joint Statement advocates a definition of \u201csovereignty\u201d in which each state\u2019s subjective perception of its \u201cpeoples\u201d, or even its \u201ccivilizational, cultural and historical\u201d reach, defines a zone of \u201cnon-interference in internal affairs\u201d that is coterminous with respective <a href=\"https:\/\/voelkerrechtsblog.org\/aggression-and-the-civilizational-turn-in-russian-politics-of-international-law\/\">spheres of influence<\/a>\u2013plainly written with the impending Ukraine invasion in mind.<\/p>\n<p>Likewise, the meaning of \u201cdemocracy\u201d is contested, not just in the domestic sphere, but in calling for the \u201cdemocratisation of international relations\u201d as a bulwark against Western and US hegemony. Yet this is no call for a system of <a href=\"https:\/\/law.mpg.de\/perspectives\/2022\/02\/28\/democracy-globalized-the-promise-to-be-fulfilled\/\"><em>equal<\/em> representation<\/a> \u2013 a global order resembling the one-state one-vote of the UN General Assembly. If this were so, both states would have submitted to the <a href=\"https:\/\/news.un.org\/en\/story\/2022\/03\/1113152\">Assembly\u2019s resolution<\/a> calling for an end to the Ukraine invasion, which was supported by an overwhelming 73% of all UN member states. Rather, both states have long fixated on the UN Security Council as the nucleus of global order and the oligarchic powers of its five permanent members. Thus \u201cdemocracy\u201d here really means <em>proportional<\/em> representation allocated according to the global power and self-perceived prestige of major states. In other words, \u201cdemocracy between states\u201d collapses into an order where <a href=\"https:\/\/www.oxfordreference.com\/view\/10.1093\/acref\/9780191866692.001.0001\/q-oro-ed6-00010932\">\u201cthe strong do what they can and the weak suffer what they must\u201d<\/a>.<\/p>\n<p><strong>\u201cDemocratisation\u201d of International Law<\/strong><\/p>\n<p>A genuinely \u201cdemocratic\u201d international legal order would in contrast promote representative engagement by individuals and <a href=\"https:\/\/www.un.org\/en\/get-involved\/un-and-civil-society\">civil society<\/a>, who have a role in contesting the legitimacy of values and principles being embedded in law. This translates into a division of labour between the participatory role of all global citizens, on the one hand, and the technocratic role of lawyers on the other. One of Australia\u2019s most distinguished foreign policy correspondents has recently served as an unwitting vehicle for Russia\u2019s disinformation campaign, by <a href=\"https:\/\/www.abc.net.au\/news\/2022-02-23\/invasion-incursion-putin-russia-ukraine-internal-law-definitions\/100853010\">publishing a lay person\u2019s interpretation<\/a> of Russia\u2019s inchoate claims. That analysis could only conclude that \u201cwhen it comes to the amorphous concept of international law, what quacks like a duck and waddles like a duck can be interpreted as a dog.\u201d Just as devaluing expertise has greatly exacerbated the harms of the COVID-19 pandemic, disregarding the <a href=\"https:\/\/www.justsecurity.org\/80454\/statement-by-members-of-the-international-law-association-committee-on-the-use-of-force\/\">overwhelming advice<\/a> of international lawyers undermines law\u2019s authority in sanctioning global threats.<\/p>\n<p>Yet, as with the global pandemic, broad engagement is warranted and indeed critical at the level of defining the underlying values to be protected by expertise. There is a reason why Kenyan Ambassador Martin Kimani created a <a href=\"https:\/\/www.lowyinstitute.org\/the-interpreter\/why-was-it-left-kenya-speak-multilateralism\">\u201csensation\u201d<\/a> in his recent condemnation of Russia before the UNSC. Kimani observed that the modern border of \u201calmost every African country, was birthed by the ending of empire\u2026 Had we chosen to pursue states on the basis of ethnic, racial or religious homogeneity, we would still be waging bloody wars these many decades later.\u201d Such words cut through inchoate legal arguments on the basis of their consistency with common understandings of order and justice. As it happens, the ambassador was also describing the rationale behind the legal doctrine of <a href=\"https:\/\/www.law.cornell.edu\/wex\/uti_possidetis_juris\"><em>uti possidetis juris<\/em><\/a>, which deems that the boundaries drawn through war and colonialism presumptively remain with the state that possesses them. But the technical scope of that rule remains primarily the concern of lawyers arguing specific cases before international courts or tribunals. No technical knowledge is required to access Kimani\u2019s words in rebuttal to illegitimate Russian legal claims.<\/p>\n<p>In this sense, law should be thought of as an imperfect but ever-evolving representation of the shared values and political agreements of real people about global order. In the specific case of the use of force, the outlawing of war as a policy instrument has acquired the status of a basic and broadly-recognised <a href=\"\/\/foreignpolicy.com\/2017\/10\/09\/what-realists-dont-understand-about-law\/\">principle of global order<\/a>, which governs narrow legal exceptions, rather than vice versa. The 2003 US led invasion of Iraq was justified through a <a href=\"http:\/\/www.sscnet.ucla.edu\/polisci\/faculty\/trachtenberg\/useur\/taft.html\">sophisticated legal argument<\/a> that UN resolutions authorising force in 1990 could be automatically revived 13 years later by Iraq\u2019s \u201cmaterial breach\u201d of obligations. The intervention was <a href=\"https:\/\/www.smh.com.au\/politics\/federal\/howard-fails-in-his-defence-of-road-to-war-20130416-2hygq.html\">patently illegal<\/a> to the vast majority of international lawyers, for illegitimately usurping the decision-making function of the UNSC. Yet even non-lawyers, faced with the superficial logic of the US argument, can start from the premise that any interpretation granting powerful states the self-judging power to declare when they are \u201cenforcing\u201d international law, is prima facie incompatible with a stable legal order.<\/p>\n<p>Putin\u2019s legal claims in Ukraine fall even below this level of a well-defined yet erroneous legal argument, with Russian officials cynically citing an <a href=\"https:\/\/www.chathamhouse.org\/2022\/02\/ukraine-debunking-russias-legal-justifications\">array of legal principles<\/a> and factual errors, without any attempt to define them or meet the relevant burden of proof, or to specify the link between legal authority and actions taken \u2013 however flawed. But for the purposes of <a href=\"http:\/\/opiniojuris.org\/2022\/03\/08\/a-visible-college-public-engagement-with-international-lawyers-during-the-ukraine-invasion\/\">political participation<\/a>, the claims can be rejected as prima facie illegitimate for suggesting that there can be any construction of international law that permits a powerful state to unilaterally dissolve the sovereignty of another state, and to use lethal force to address its grievances about the regional balance of power.<\/p>\n<p><strong>A More Normatively Desirable International Legal Order<\/strong><\/p>\n<p>The Russia-China Joint Statement declares commitment to \u2018the international law-based world order\u2019 as among its central pillars, which is contrasted with an order based on \u2018rules elaborated in private by certain nations or blocs of nations\u2019. These words seek to consolidate what both states have, until now, perceived as a rhetorical advantage over their Western counterparts, who more often advocate in terms of the <a href=\"https:\/\/law.unimelb.edu.au\/__data\/assets\/pdf_file\/0005\/4061939\/Jorgensen-advance-copy.pdf\">\u201crules-based order\u201d<\/a>. Russian Foreign Minister Sergey Lavrov has <a href=\"https:\/\/russiaeu.ru\/en\/news\/excerpts-russian-foreign-minister-sergey-lavrovs-remarks-roundtable-discussion-participants\">frequently criticised<\/a> \u201cthe trend of our Western partners to make fewer references to international law or even remove it from the international lexicon altogether\u201d. For Lavrov, this positions Russia and China as the <a href=\"https:\/\/www.mid.ru\/en\/foreign_policy\/news\/-\/asset_publisher\/cKNonkJE02Bw\/content\/id\/4867111\">true guardians of international law<\/a>, with the \u201crules-based order\u201d symbolising a \u201cdangerous relapse into bloc policy and creation of dividing lines between a group of Western countries and other states\u201d.<\/p>\n<p>There is little substance behind this rhetoric, with both sides equally offering a competing vision for the future of international law. The imputation has no doubt been sustained by the US and its Western allies repeatedly using force in controversial or blatantly illegal circumstances \u2013 with <a href=\"https:\/\/undocs.org\/S\/2022\/154\">Putin, on the eve of war<\/a>, naming Kosovo, Iraq, Libya and Syria as \u201cthe most egregious, but by no means the only, examples of disregard for international law.\u201d But the Joint Statement is flawed not because it identifies Western states as sometimes hypocritical, but because it seeks to transform law into a tool that would never contradict Russian and Chinese interests. From that perspective, any credibility in criticisms of the \u201crules-based order\u201d is entirely nullified by Russia\u2019s brutal invasion of Ukraine and the <a href=\"https:\/\/www.fmprc.gov.cn\/eng\/zxxx_662805\/202202\/t20220226_10645855.html\">acquiescence or tacit support of China<\/a>.
