Dr. h.c. Claus Kre\u00df, LL.M (Cambridge) hosted the sixth Hans Kelsen Memorial Lecture on International Peace and Security Law. Dr. Ronen Steinke gave this year&#8217;s keynote lecture entitled \u201cA Means to an End: How Fritz Bauer Used the Courtroom for a Reckoning with the German Past\u201d.<\/p>\n<p>The lecture series is dedicated to the memory of the eminent legal theorist and international legal scholar Hans Kelsen. Hans Kelsen was appointed Chair at the Cologne Law Faculty in 1929. He took up the position in 1930 and was made the faculty&#8217;s Dean in 1932. In 1933, he was expelled from his post by the Nazi government. Each year, a leading figure in the field of peacekeeping law is invited to deliver a Hans Kelsen Memorial Lecture, followed by a small privatissimum the next day.<\/p>\n<p>This year&#8217;s memorial lecture was dedicated to the life and work of Fritz Bauer, who is considered one of the most important trailblazers of the Frankfurt Auschwitz Trials. Dr. Steinke shed light on Bauer&#8217;s understanding of criminal law, who in no way intended the Frankfurt trial to be a means of retaliation, but rather pursued solely preventive purposes. The idea of prevention, however, did not apply to the 22 defendants themselves, but to the German people, who were shown the horrors of Auschwitz for the first time through the trial. Dr. Steinke impressively demonstrated that Bauer&#8217;s implementation of his theory in practice, however, also entailed a harsh consequence. In the end, Bauer admitted to seeing the defendants in the Auschwitz trials as \u201cscapegoats\u201d who were needed to teach society a lesson, and thus also \u201cA Means to an End\u201d.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: center\">&#8212;&#8212;&#8212;<\/p>\n<p>&nbsp;<\/p>\n<p>Am 18.11.2021 richtete das Institute for International Peace and Security Law der Universit\u00e4t zu K\u00f6ln unter der Leitung seines Direktors Professor Dr. Dr. h.c. Dr. h.c. Claus Kre\u00df, LL.M (Cambridge) die sechste Hans Kelsen Memorial Lecture on International Peace and Security Law aus. Dr. Ronen Steinke hielt den diesj\u00e4hrigen Festvortrag mit dem Titel \u201eA Means to an End: How Fritz Bauer Used the Courtroom for a Reckoning with the German Past\u201c.<\/p>\n<p>Die Vortragsreihe ist dem Andenken an den bedeutenden Rechtstheoretiker und V\u00f6lkerrechtler Hans Kelsen gewidmet. Hans Kelsen wurde 1929 an einen Lehrstuhl der K\u00f6lner juristischen Fakult\u00e4t berufen. Er trat die Stelle 1930 an und war ab 1932 Dekan der Fakult\u00e4t. Im Jahr 1933 wurde er von den Nationalsozialisten aus seinem Amt vertrieben. Jedes Jahr wird eine f\u00fchrende Pers\u00f6nlichkeit auf dem Gebiet des Friedenssicherungsrechts eingeladen, eine Hans Kelsen Memorial Lecture zu halten, an die sich am n\u00e4chsten Tag ein kleines Privatissimum anschlie\u00dft.<\/p>\n<p>Der diesj\u00e4hrige Festvortrag wurde dem Leben und Wirken von Fritz Bauer gewidmet, der als einer der bedeutendsten Wegbereiter der Frankfurter Auschwitzprozesse gilt. Dr. Steinke beleuchtete das Strafrechtsverst\u00e4ndnis von Bauer, der mit dem Frankfurter Prozess keinesfalls Vergeltung \u00fcben wollte, sondern allein pr\u00e4ventive Zwecke verfolgte. Der Gedanke der Pr\u00e4vention galt hier aber nicht den 22 Angeklagten selbst, sondern der deutschen Bev\u00f6lkerung, die sich durch den Prozess zum ersten Mal ein Bild vom Ausma\u00df des Grauens in Auschwitz verschaffen konnte. Dr. Steinke zeigte eindrucksvoll auf, dass Bauers Umsetzung seiner Theorie in die Praxis damit jedoch zugleich eine harte Konsequenz nach sich zog. So sah Bauer die Angeklagten der Auschwitzer Prozesse letztlich, und er selbst gab dies so zu, mindestens auch als \u201eS\u00fcndenb\u00f6cke\u201c, die es br\u00e4uchte, um der Gesellschaft eine Lehre zu vermitteln und damit mindestens auch als Mittel zum Zweck \u2013 \u201eA Means to an End\u201c.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 18 November 2021, the Institute for International Peace and Security Law of the University of Cologne, under the leadership of its Director, Professor Dr. Dr. h.c.
