{"id":13856,"date":"2021-05-12T09:55:31","date_gmt":"2021-05-12T07:55:31","guid":{"rendered":"https:\/\/voelkerrechtsblog.org\/?p=13856"},"modified":"2021-05-12T18:47:47","modified_gmt":"2021-05-12T16:47:47","slug":"the-dreadful-night-goes-on","status":"publish","type":"post","link":"https:\/\/voelkerrechtsblog.org\/de\/the-dreadful-night-goes-on\/","title":{"rendered":"The Dreadful Night Goes On"},"content":{"rendered":"<p>At times, words fail to describe the horrors of reality. That is until we have recourse to the language of international criminal law (ICL). While its use may be problematic, helping hegemonies narrate their political and military struggles in a way that frames their enemies <a href=\"https:\/\/academic.oup.com\/jicj\/article\/14\/4\/939\/2236031?login=true\">alone<\/a> as <em>hostis humani generis<\/em>, few areas of knowledge describe state violence so aptly. Thus, one should not be too quick to discard ICL as an interpretive framework for the systematic state repression of largely peaceful demonstrations in Colombia. In fact, approaching this crisis from the perspective of international crimes and legitimate responses to their commission could prove useful. If not to extinguish the fire, at least to hold accountable those who set it alight.<\/p>\n<p>Since 28 April, Colombian authorities have conducted a <a href=\"https:\/\/www.nytimes.com\/2021\/05\/05\/world\/americas\/colombia-covid-protests-duque.html?fbclid=IwAR3MpSv_3RODjEmvV2KvLPO5YpGSqDMxoWnADweiC3UuSWCaxP60VfWbugI\">brutal crackdown<\/a> on <a href=\"https:\/\/abcnews.go.com\/International\/explainer-bloody-protests-colombia-leave-26-dead\/story?id=77539421\">demonstrations<\/a> against an unpopular <a href=\"https:\/\/www.ey.com\/en_gl\/tax-alerts\/colombia-s-executive-branch-submits-tax-reform-bill-to-congress\">tax bill<\/a>and the <a href=\"https:\/\/www.britannica.com\/biography\/Ivan-Duque\">Duque<\/a> administration <a href=\"https:\/\/www.americasquarterly.org\/article\/five-challenges-facing-ivan-duque-at-his-presidencys-halfway-point\/\">more broadly<\/a>. Despite sporadic clashes and the erection of roadblocks, most notably around Cali, the conduct of protests has been <a href=\"https:\/\/www.crisisgroup.org\/latin-america-caribbean\/andes\/colombia\/pandemic-gloom-and-police-violence-leave-colombia-turmoil\">generally peaceful<\/a>. It bears <a href=\"https:\/\/digitallibrary.un.org\/record\/3884725\">recalling<\/a> that isolated instances of violence \u201cwill not suffice to taint an entire assembly as non-peaceful\u201d. In addition, the \u201cdisruption of vehicular or pedestrian movement or daily activities\u201d is not considered as violent action. Nevertheless, at the time of writing, <em>Indepaz <\/em>and <em>Temblores ONG<\/em><a href=\"https:\/\/www.infobae.com\/america\/colombia\/2021\/05\/10\/indepaz-y-temblores-ong-elevan-a-47-la-cifra-de-asesinados-durante-11-dias-de-manifestaciones-en-colombia\/\">reported<\/a> 47 deaths, 278 victims of assault, 963 arbitrary detentions, and 12 victims of sexual violence. Moreover, the Ombudsman informed about 548 missing persons. The <a href=\"https:\/\/www.oas.org\/es\/CIDH\/jsForm\/?File=\/es\/cidh\/prensa\/comunicados\/2021\/118.asp\">Inter-American Commission on Human Rights<\/a>, the United Nations (UN) <a href=\"https:\/\/colombia.unmissions.org\/comunicado-del-sistema-de-las-naciones-unidas-en-colombia%C2%A0\">Verification Mission in Colombia<\/a>, the <a href=\"https:\/\/news.un.org\/es\/story\/2021\/05\/1491612\">Representative of the Office of the UN High Commissioner for Human Rights<\/a>, and the <a href=\"https:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=27075&amp;LangID=E\">UN Committee on Enforced Disappearances<\/a> have issued statements expressing their concern.<\/p>\n<p>Colombia is a <a href=\"https:\/\/asp.icc-cpi.int\/en_menus\/asp\/states%20parties\/latin%20american%20and%20caribbean%20states\/Pages\/colombia.aspx\">party<\/a> to the <a href=\"https:\/\/www.icc-cpi.int\/Publications\/Rome-Statute.pdf\">Rome Statute<\/a> (RSt) since 01 November 2002. It is, therefore, reasonable to consider whether such massive acts of violence constitute crimes against humanity (CAH) within the jurisdiction of the International Criminal Court (ICC). Certainly, the wave of police, military, and \u2013 perhaps more worryingly \u2013 <a href=\"https:\/\/www.noticiasuno.com\/nacional\/noticias-uno-obtuvo-audios-de-grupo-de-civiles-en-cali-que-habla-de-defenderse-con-armas\/\">paramilitary<\/a> violence constitutes an example of what David Luban <a href=\"https:\/\/scholarship.law.georgetown.edu\/facpub\/146\/#:~:text=Crimes%20against%20humanity%20represent%20the,political%20life%20will%20destroy%20us.\">describes<\/a> as cancerous politics hell-bent on destroying individual and collective aspects of human existence. It has turned membership in a political community \u2013 the Indigenous Guard, a labour union, or the demonstration itself, however ephemeral it may be \u2013 into a death trap.<\/p>\n<p>Article 7 RSt and its attendant <a href=\"https:\/\/www.icc-cpi.int\/Publications\/Elements-of-Crimes.pdf\">Elements of Crimes<\/a> (EoC) describe CAH as any underlying act mentioned in paragraph (1), letters (a) through (k), when committed in the context of a widespread or systematic attack, carried out pursuant to or in furtherance of a state or organisational policy, against any civilian population, and with knowledge of the attack. These elements will be analysed in turn with regard to the situation in Colombia.<\/p>\n<p>Under Article 7(2)(a) RSt, an <strong>attack <\/strong>is \u201ca course of conduct involving the multiple commission of acts referred to in paragraph 1\u201d. The EoC clarify that they \u201cneed not constitute a military attack\u201d. Hence, in light of the recent judgment in <a href=\"https:\/\/www.icc-cpi.int\/CourtRecords\/CR2019_03568.PDF\"><em>Ntaganda<\/em><\/a>, it suffices to establish the commission of a number of acts within \u201ca series or overall flow of events\u201d. This appears to be the case in Colombia, given that <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2021\/05\/colombia-amnistia-denuncia-respuesta-militarizada-represion-policial\/\">numerous acts<\/a> of <a href=\"https:\/\/cuestionpublica.com\/en-memoria-victimas-mortales-abuso-policial-violencia-movilizaciones-sociales\/\">murder<\/a>, <a href=\"https:\/\/www.nytimes.com\/es\/2021\/05\/09\/espanol\/opinion\/protestas-colombia.html\">severe deprivation of physical liberty<\/a>, <a href=\"https:\/\/www.elespectador.com\/noticias\/nacional\/que-rico-echarles-gases-la-violencia-sexual-en-el-paro-nacional\/\">sexual violence<\/a>, <a href=\"https:\/\/www.lafm.com.co\/colombia\/cifra-de-desaparecidos-en-el-paro-nacional-ascendio-548-segun-defensoria\">enforced disappearance<\/a>, and other inhumane acts have been committed over the last fortnight.<\/p>\n<p>The attack must be committed pursuant to or in furtherance of a <strong>policy <\/strong>that, for the purpose of the situation in Colombia, emanates from the <strong>state<\/strong>. According to the confirmation decision in <a href=\"https:\/\/www.icc-cpi.int\/CourtRecords\/CR2012_01004.PDF\"><em>Ruto &amp; Sang<\/em><\/a>, this refers to a design \u201cto carry out an attack against a civilian population\u201d. The <a href=\"https:\/\/www.icc-cpi.int\/CourtRecords\/CR2021_01026.PDF\"><em>Ongwen<\/em><\/a> judgment compiled indicia of its existence that include, <em>inter alia<\/em>, statements condoning the commission of crimes and underlying motives. It is therefore telling that high-ranking Colombian officials have failed to categorically reject the conduct of the security apparatus. Instead, public officials have either accused demonstrators of being \u201c<a href=\"https:\/\/www.bbc.com\/mundo\/noticias-america-latina-56910570\">terrorists<\/a>\u201d or issued feeble calls for the rejection of \u201c<a href=\"https:\/\/www.reuters.com\/world\/americas\/un-eu-call-calm-colombia-protests-warn-excessive-force-2021-05-04\/\">violence<\/a>\u201d, without explicitly disavowing police excesses. Moreover, the defence minister <a href=\"https:\/\/twitter.com\/Diego_Molano\/status\/1388427595499311107\">expressed<\/a> \u201cgratitude and admiration\u201d for the security forces and attributed violence to <a href=\"https:\/\/www.reuters.com\/article\/us-colombia-protests-idAFKBN2CK1MZ\">organised armed groups<\/a> (OAGs) or <a href=\"https:\/\/www.eltiempo.com\/justicia\/investigacion\/ministro-de-defensa-habla-sobre-venezolanos-en-bloqueos-de-vias-586768\">Venezuelan citizens<\/a>. President Duque, meanwhile, called for <a href=\"https:\/\/www.france24.com\/en\/live-news\/20210505-fears-of-militarization-as-colombian-soldiers-confront-protesters\">military assistance<\/a> in cities affected by police brutality and ordered a <a href=\"https:\/\/www.facebook.com\/ivanduquemarquez\/videos\/251064386503189\">full army and police mobilisation<\/a> into Cali on 09 May. It seems that their policy is to end peaceful demonstrations at all cost.<\/p>\n<p>The abovementioned figures for prohibited acts indicate the <strong>widespread<\/strong> character of the attack, which \u201cconnotes [its] large-scale nature (\u2026) and the number of targeted persons\u201d. It is also worth mentioning that they have occurred in <a href=\"https:\/\/cerosetenta.uniandes.edu.co\/la-geografia-de-la-violencia-policial\/\">several cities<\/a> for almost two weeks. The <em>alternative <\/em>qualifier concerning the <strong>systematic <\/strong>quality of the attack, which refers to the \u201corganised nature of the violent acts (\u2026) and the improbability of their random or accidental occurrence,\u201d could be inferred from the following patterns:<\/p>\n<ul>\n<li>After mostly peaceful demonstrations in broad daylight, coordinated police operations began in vulnerable neighbourhoods at <a href=\"https:\/\/www.reuters.com\/world\/americas\/colombia-unions-hold-mass-marches-violence-worse-overnight-bogota-2021-05-05\/\">night<\/a>. For instance, attacks in <a href=\"https:\/\/www.elespectador.com\/noticias\/judicial\/denuncian-que-helicoptero-de-la-policia-aterrizo-abusivamente-en-un-colegio-en-bogota\/\">Bogot\u00e1<\/a>, <a href=\"https:\/\/www.elespectador.com\/noticias\/nacional\/violenta-noche-de-protesta-en-cali\/\">Cali<\/a>, and <a href=\"https:\/\/www.elespectador.com\/noticias\/nacional\/paro-nacional-caos-en-medellin-en-la-noche-de-la-septima-jornada-del-paro-nacional\/\">Medell\u00edn<\/a> all happened after dusk;<\/li>\n<li>Some acts were committed under the cover of <a href=\"https:\/\/www.eltiempo.com\/colombia\/cali\/paro-nacional-en-cali-2021-denuncian-que-policia-disparo-contra-civiles-585174\">power<\/a> or <a href=\"https:\/\/netblocks.org\/reports\/internet-disrupted-in-colombia-amid-anti-government-protests-YAEvMvB3\">internet<\/a> outages, which were <a href=\"https:\/\/twitter.com\/cvoule\/status\/1391383486771118082\">denounced<\/a> by the UN Special Rapporteur on Freedom of Association and Peaceful Assembly;<\/li>\n<li>The use of force appears to be <a href=\"https:\/\/www.elespectador.com\/noticias\/bogota\/venom-el-arma-en-la-tanqueta-del-esmad-que-causo-panico-en-el-sur-de-bogota-en-el-paro-nacional\/\">disproportionate<\/a>, and police officers seem to <a href=\"https:\/\/twitter.com\/JMVivancoHRW\/status\/1390396994804502535\">relish<\/a> it;<\/li>\n<li>Police officers <a href=\"https:\/\/mundo.sputniknews.com\/20210506\/colombia-hoy-policias-ocultan-su-identificacion-durante-las-protestas-1111938079.html\">remove badge numbers<\/a> from their uniforms or wear <a href=\"https:\/\/www.elespectador.com\/noticias\/judicial\/paro-nacional-policia-admite-que-camion-con-hombres-vestidos-de-civil-es-suyo\/\">plain clothes<\/a> before utilising excessive force, and;<\/li>\n<li>Recently, civilians have launched armed attacks against <a href=\"https:\/\/www.counterpunch.org\/2021\/05\/07\/colombia-on-the-brink\/\">peaceful demonstrators<\/a> and the <a href=\"https:\/\/www.infobae.com\/america\/colombia\/2021\/05\/09\/terror-en-jamundi-graban-a-varios-civiles-armados-amenazando-y-disparando-contra-la-guardia-indigena\/\">Indigenous Guard<\/a> with the acquiescence of security forces. The latter is a grave cause for concern because it poses the risk of commission not only of CAH, but also of genocide.<\/li>\n<\/ul>\n<p>The attack must be directed at a <strong>civilian population<\/strong>. Thus, according to the <a href=\"https:\/\/www.icc-cpi.int\/CourtRecords\/CR2015_04025.PDF\"><em>Katanga<\/em><\/a> judgment, its intended target must be a collective that is primarily composed of civilians, \u201cas opposed to \u2018members of armed forces and other legitimate combatants\u2019\u201d, regardless of their distinguishing features. Despite allegations from the defence minister that demonstrations were infiltrated by OAGs, no credible information substantiating his claims has surfaced. On the contrary, publicly available footage indicates that violence has been directed at unarmed civilians.<\/p>\n<p>Additionally, the <strong>nexus <\/strong>requirement excludes isolated acts whose nature, aims, and consequences differ from the attack. In Colombia, it seems that underlying acts are closely linked to the repression of protests. Hence, they broadly appear to fulfil the requisite nexus.<\/p>\n<p>Lastly, the perpetrators must be <strong>aware <\/strong>of the circumstances constituting the attack in the course of which they committed prohibited acts. They do not require a detailed understanding of the attack or the policy behind it and their motives are irrelevant. It would be difficult to imagine that persons allegedly responsible for the commission of CAH in Colombia ignore the context of their behaviour.<\/p>\n<p>For the foregoing reasons, there are grounds to believe that the CAH of murder, severe deprivation of physical liberty, sexual violence, and enforced disappearance are being committed in Colombia. Furthermore, since the violence is directed at disenfranchised communities and ethnic groups, it would be worth considering whether it also constitutes persecution on socio-economic and ethnic grounds. This could shed light on the structural causes of discrimination that have traditionally infected all aspects of Colombian life.<\/p>\n<p>These crimes also appear to be sufficiently <a href=\"http:\/\/www.qil-qdi.org\/factors-relevant-assessment-sufficient-gravity-icc-proceedings-elements-international-crimes\/\">grave<\/a>. In terms of scale, they affected hundreds of persons over a wide temporal and territorial scope. Regarding their nature, they represent gross violations of the rights to <a href=\"https:\/\/voragine.co\/llevame-contigo-amor-la-noche-oscura-de-sandra-la-madre-de-santiago-murillo\/\">life<\/a>, <a href=\"https:\/\/www.elespectador.com\/noticias\/bogota\/no-solo-le-paso-a-leidy-los-otros-jovenes-que-han-perdido-un-ojo-en-marchas-en-bogota\/\">integrity<\/a>, <a href=\"https:\/\/www.elespectador.com\/judicial\/temblores-reporta-aumento-de-detenciones-y-violencia-policial-en-el-paro-nacional-article\/\">liberty<\/a>, and freedom from <a href=\"https:\/\/www.elespectador.com\/colombia2020\/pais\/relatos-del-horror-las-torturas-que-habrian-sufrido-capturados-por-la-policia-en-el-paro-nacional\/\">inhumane treatment<\/a> or <a href=\"https:\/\/www.amnesty.org\/es\/latest\/news\/2021\/05\/colombia-preocupan-las-denuncias-de-desapariciones-y-violencia-sexual-contra-manifestantes\/\">sexual violence<\/a>. Information about the manner of commission of the crimes indicates that they may be attributable to public servants who abused their authority and subverted their <a href=\"https:\/\/www.corteconstitucional.gov.co\/relatoria\/2002\/C-251-02.htm\">constitutional duty<\/a> to protect the life, integrity, and liberty of the people. Furthermore, they appeared to act wantonly and to enjoy the suffering they caused upon the civilian population. Additionally, the Indigenous Guard appears to be targeted on discriminatory grounds. For instance, president Duque <a href=\"https:\/\/www.semana.com\/nacion\/articulo\/duque-les-pide-a-los-indigenas-volver-a-sus-resguardos\/202128\/\">called on them<\/a> to \u201creturn to their reservations\u201d in order to avoid \u201cunnecessary confrontations\u201d. In the current security climate, his words represent a thinly veiled threat of ethnic violence.<\/p>\n<p>But naming the beast is not enough. It is also necessary to find ways to tame it.<\/p>\n<p>Diplomatic action for the imposition of <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2015-title22\/pdf\/USCODE-2015-title22-chap32-subchapIII-partI-sec2378d.pdf\">limitations on military assistance<\/a> and targeted sanctions \u2013 i.e. under <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/PLAW-114publ328\/html\/PLAW-114publ328.htm\">United-Statesian<\/a> and <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/PDF\/?uri=OJ:L:2020:410I:FULL&amp;from=EN\">European<\/a> \u201cMagnitsky\u201d acts \u2013, as well as legal proceedings to obtain <a href=\"http:\/\/www.oas.org\/en\/iachr\/mandate\/basics\/rulesiachr.asp\">precautionary measures<\/a> and to ascertain Colombia\u2019s responsibility under the <a href=\"https:\/\/www.cidh.oas.org\/basicos\/english\/basic3.american%20convention.htm\">American Convention on Human Rights<\/a> should be pursued. Nevertheless, they are not enough. We must <a href=\"https:\/\/avalon.law.yale.edu\/imt\/judlawch.asp\">remember<\/a> that: \u201cCrimes against international law are committed by men, not by abstract entities, and only by punishing individuals who commit such crimes can the provisions of international law be enforced.\u201d<\/p>\n<p>Consequently, we should explore avenues to guarantee that CAH will not go unpunished. Due to the <a href=\"https:\/\/razonpublica.com\/fiscal-barbosa-se-puede-esperar\/\">politicisation<\/a> of Colombia\u2019s Office of the Attorney General and Congress\u2019 <a href=\"https:\/\/www.semana.com\/nacion\/articulo\/comision-de-acusaciones\/419959-3\/\">appalling record<\/a> on accountability, an international response seems appropriate.<\/p>\n<p>ICC intervention in Colombia is unlikely. Indeed, the ongoing <a href=\"https:\/\/www.icc-cpi.int\/colombia\">preliminary examination<\/a> is focussed on evaluating the <a href=\"https:\/\/www.icc-cpi.int\/itemsDocuments\/2020-PE\/2020-pe-report-eng.pdf\">admissibility<\/a> of proceedings for the crimes that were identified by the Office of the Prosecutor (OTP) in its 2012 <a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=Situation-in-Colombia-Interim-Report\">interim report<\/a>. Notwithstanding the ongoing submission of information related to Colombia under article 15 RSt, the growing OTP docket \u2013 which is set to include complex situations in <a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=201211-prosecutor-statement\">Nigeria<\/a>, <a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=210303-prosecutor-statement-investigation-palestine\">Palestine<\/a>, and <a href=\"https:\/\/www.icc-cpi.int\/Pages\/item.aspx?name=201211-otp-statement-ukraine\">Ukraine<\/a> \u2013 does not appear to leave room for further engagement with Colombia.<\/p>\n<p>International justice, however, does not stop at the ICC. Recent experiences in <a href=\"https:\/\/iiim.un.org\/\">Syria<\/a> and <a href=\"https:\/\/www.unitad.un.org\/\">Iraq<\/a> offer examples of how investigative mechanisms may build robust case files that could be transferred to foreign authorities for prosecution. Furthermore, the <a href=\"https:\/\/www.swissinfo.ch\/eng\/politics\/war-crimes-cases-on-the-rise-despite-covid-19-46586390?utm_campaign=own-posts&amp;utm_content=o&amp;utm_source=twitter&amp;utm_medium=socialflow\">rise<\/a> of universal jurisdiction cases gives reason to hope that, regardless of the <a href=\"https:\/\/academic.oup.com\/jicj\/article-abstract\/13\/2\/245\/896503?redirectedFrom=fulltext\">shift<\/a> from a \u201cglobal enforcer\u201d to a \u201cno safe haven\u201d paradigm, this continues to be a powerful tool in the fight against impunity. Faced with the gravity of the CAH allegedly committed in Colombia, which not only threaten basic human guarantees but perhaps even (formal) democracy, it would not be unreasonable to consider having recourse to one of the few nations that <a href=\"https:\/\/www.hrw.org\/sites\/default\/files\/related_material\/IJ0914German_0.pdf\">exceptionally<\/a>allow for trials <em>in absentia<\/em> under universal jurisdiction, such as <a href=\"http:\/\/www.gesetze-im-internet.de\/englisch_vstgb\/englisch_vstgb.html\">Germany<\/a>.<\/p>\n<p>Interpreting the crisis in Colombia through the lens of ICL helps us make sense of extraordinary chaos and express profound repudiation for such evil. But we should not stop there.
