The talk unpacks the concept of an illegal occupation as understood by the ICJ and its judges, arguing that only self-defence could potentially justify Israel’s continued occupation under jus ad bellum. It outlines five
possible approaches to the 2024 Advisory Opinion on this issue and evaluates their validity, with a focus on the link between lawful self defence and the principles of necessity and proportionality.
Marko Milanović is Professor of Public International Law at the University of Reading School of Law and Director of the Global Law at Reading research group. He is co-general editor of the ongoing Tallinn Manual 3.0 project and co-editor of EJIL: Talk!, the blog of the European Journal of International Law, as well as a member of the EJIL’s Editorial Board. Professor Milanović has held visiting appointments at law schools around the world and has acted as counsel or advisor before numerous international courts and tribunals.
